تهدف هذه الدراسة لإعادة التوازن المعرفي بين الأطراف المتعاقدة عن طريق توفير الحماية الحقيقية للمستهلك، كونه يعتبر الطرف الضعيف في المعاملات التي تخص المجال الإلكتروني ويكون ذلك بإعلام الطرفين على مرحلتين قبل التعاقد أولا ومرحلة ثانية بعد التعاقد. يعتبر الإلتزام بالإعلام من أهم الضمانات التي تحمي المستهلك من الإحتيال و غيره، لذلك تبرز أهميته بشكل أكبر في التعاقد الإلكتروني الذي يتم عن بعد، هذا أقر المشرع الجزائري بوضع آليات من أجل حماية المستهلك، و أقر كذلك بقيام الجزاءات المدنية كالتعويض عن الضرر الذي يمس المستهلك والجزاءات جزائية التي يعاقب القانون أخرى. الكلمات المفتاحية: إعادة التوازن، الإلتزام بالإعلام، المستهلك. Abstract: This study aims to restore the informational balance between contracting parties by providing genuine protection for the consumer, who isconsidered the weaker party in electronic transactions. This is achieved by informing both parties in two stages: first before the contract is concluded, and second after the contract is concluded. The obligation to inform is one of the most important guarantees that protect the consumer from fraud and other issues. Therefore, its importance is even greater in electronic contracts, which are conducted remotely. For this reason, the Algerian legislator has established mechanisms to protect consumers and has also provided for civil penalties, such as compensation for damage affecting the consumer, as well as other criminal penalties.
