يعد الحجز العقاري من أهم الوسائل القانونية، حيث تمكن الدائن من حماية حقوقه عبر تقييد حرية المدين في التصرف بعقاره، ويصنف الحجز العقاري كإجراء تحفظي، قد يتحول إلى إجراء تنفيذي في حال صدور حكم نهائي لصالح الدائن، مما يبرز أهميته في تحقيق الأمن القانوني والتوازن في المعاملات المدنية والتجارية. ويعرف بأنه طريق يمكن الدائن من وضع عقارات مملوكة لمدينه أو لغيره والذي يملك حق التتبع عليها تحت يد القضاء لبيعها بالمزاد العلني، ثم إستيفاء حقه من ثمنها وقد نظمه المشرع الجزائري في المواد من 721 إلى 774 قانون الإجراءات المدنية والإدارية. Abstract : Real estateseizureisconsidered one of the most important legalmechanisms, as itallows the creditor to protecttheirrigates by restricting the debtor’sability to dispose of theirproperty. It isclassified as a precautionarymeasurethatmayturninto an enforcementprocedure if a final judgmentisissued in favor of the creditor. This highlightsits importance in ensuringlegalsecurity and balance in civil and commercial transactions. It isdefined as a legalprocessthatenables the creditor to place immovablepropertyowned by the debtor- or by anotherperson over whom the creditor has a right of pursuit-under the authority of the court for public auction, sothatthecreditormayrecovertheirduefrom the proceeds. The Algerian legislator has regulatedthisprocedure in Articles 721 to 774 of the code of civil and administrative procedure.
