يعتبر عقد الايجار من العقود المسماة والتي تخضع إلى مبدأ سلطان الارادة والتي تصدر من علاقة بين طرفي العقد وهما المؤجر والمستأجر، وذلك لتوفر مجموعة من الأركان لإتمام إبرام عقد الايجار في مجال السكات العمومية الإيجارية التي ترجع ملكيتها وإدارتها لدواوين الترقية والتسيير العقاري والتي تسمى مرحلة تنفيذ العقد، غير أن هذا الأخير مرتبط قانونيا بمجموعة من الآثار تلحق بعقد الإيجار، الأمر الذي يؤدي إلى نشوء نزاعات يترتب عليها رفع دعاوى من قبل الطرفين لسبب إخلال كل منهما بما يكون مفروض عليه من واجيات. الكلمات المفتاحية: عقد الإيجار، السكنات الإيجارية، العقد.
