يعد التحكيم التجاري الدولي وسيلة بديلة لفض المنازعات، والتي تغني عن اللجوء إلى القضاء العام في الدولة لاسيما في النزاعات ذات الطابع التجاري الدولي، بحيث يتفق الأطراف مسبقا من خلال اتفاقية التحكيم على إحالة النزاع الذي قد ينشأ بينهم إلى الهيئة التحكيمية والتي تتولى الفصل فيه وفقا لإجراءات التحكيم المنصوص عليها قانونا. تصدر الهيئة التحكيمية حكمها الفاصل في النزاع والذي لابد من الاعتراف به لتمنح له الصيغة التنفيذية، لكن ومع ذلك، فإن هذا الحكم يمكن الطعن فيه حسب الطرق التي نص عليها المشرع الجزائري في قانون الإجراءات المدنية والإدارية. الكلماتالمفتاحية: التحكيم التجاري الدولي – الاتفاق- هيئة التحكيم- الخصومة- الحكم التحكيمي- الاعتراف والتنفيذ- الطعن. Abstract: International commercial arbitration is an alternative means of dispute resolution, eliminating the need to resort to the general courts in the country, particularly in disputes of an international commercial nature. The parties agree in advance, through the arbitration agreement, to refer any dispute that may arise between them to an arbitration tribunal, which shall adjudicate it in accordance with the arbitration procedures stipulated by law. The arbitration tribunal issues its final award in the dispute, which must be recognized for it to be enforceable. However, this award may be appealed in accordance with the procedures stipulated by the Algerian legislator in the Code of Civil and Administrative Procedure.
