تعتبر المراقبة الإلكترونية عن طريق السوار الإلكتروني من الوسائل المستحدثة في السياسة العقابية الحديثة وتعد من أهم وأبرز تطبيقات التطور العلمي العقابي الذي أظهر ضرورة إيجاد بدائل للعقوبة السالبة للحرية بغير الأساليب التقليدية، وقد لجأت العديد من الدول المتقدمة إلى استخدام هذه الوسيلة لما لها من أهمية كبرى في التقليل من مساوئ العقوبة السالبة للحرية وإعادة إصلاح الجناة وتأهيلهم إجتماعيا وقد أخذ المشرع الجزائري بنظام السوار الإلكتروني وذلك من خلال القانون 18-01 حيث نظم أحكامه وبين شروطه وكيفية إلغائه وانتهائه. الكلمات المفتاحية : المراقبة الإلكترونية، السوار الإلكتروني، العقوبة البديلة للحبس قصيرة المدة، العقوبة السالبة للحرية قصيرة المدة. Abstract: Electronic monitoring through the use of an electronic bracelet is considered one of the modern tools in contemporary penal policy. It stands out as one of the most significant applications of scientific advancement in the field of criminal justice, highlighting the need to find alternatives to custodial sentences beyond traditional methods. Many developed countries have adopted this measure due to its considerable importance in reducing the negative effects of short-term imprisonment and in promoting the rehabilitation and social reintegration of offenders. The Algerian legislator has adopted the electronic bracelet system through Law No. 18-01, which regulates its provisions, defines its conditions, and outlines the procedures for its cancellation and termination.
