Item مكافحة الجريمة البيئية في التشريع الجزائري(مكتبة كلية الحقوق والعلوم السياسية جامعة محمد البشير الإبراهيمي برج بوعريريج, 2025-01) خبابة, سهيلة; عثماني, نور الهدىإن دراسة موضوع مكافحة الجريمة البيئية في التشريع الجزائري يبين لنا المكانة المهمة للبيئة لدى المشرع، الذي وضع الكثير من القوانين العامة والخاصة لحمايتها ومكافحة الجريمة المتعلقة بها منها القانون الأخير 03/10 المتعلق بحماية البيئة في إطار التنمية المستدامة، وكذا عبر منح صلاحيات للهيئات الإدارية والمدنية والجزائية بوضع آليات ووسائل وقائية وردعية تهدف في مجملها إلى الحد أو القضاء على الجريمة البيئية. بالرغم من توفر النصوص القانونية والوسائل المساعدة لها لحماية البيئة إلا أن هذه الترسانة القانونية لم تتمكن من حماية البيئة والتي لن نصل إليها إلا من خلال دمج المواطنين وإشراكهم في العمل التوعوي باعتبارهم العنصر الحساس والفعال في البيئة. الكلمات المفتاحية: الجريمة البيئية، الآليات القانونية، المسؤولية الجزائية، الحماية الجنائية، الحماية غير جنائية. Abstract The study of the subject of combating environmental crime in Algerian legislation shows us the important position of the environment for the legislator through the enactment of Law 03/10 relating to the protection of the environment within the framework of sustainable development, as well as various laws related to the environment, such as the law on waste and the law on water...etc. It appears clear to us the great attention that the Algerian legislator has given to the environment and everything that affects it, by involving various general and special laws in its protection and combating related crimes by granting powers to administrative, civil, and criminal authorities to establish preventive and deterrent mechanisms and means aimed at limiting or eliminating environmental crime. Despite the availability of legal texts and supporting means for environmental protection, this legal arsenal has not been able to protect the environment, which we can only achieve through integrating citizens and involving them in awareness-raising work, considering them as the sensitive and effective element in the environment.
