الملكية العقارية المشتركة ذات وضعية عقارية خاصة التي تكون عليها العقارات المبنية مقسمة بين عدة أشخاص وفق حصص تحتوي كل حصة على جزء خاص ينفرد به المالك كالشقة، ونصيب في الأجزاء المشتركة كالجدران، والتي لا يمكن أن تكون محلا لدعوى التقسيم أو بيعا بالمزايدة بمعزل عن الأجزاء الخاصة، ولضمان حسن سير إدارة الملكية المشتركة و المحافظة عليها وضع المشرع آليات ، كما منح للملاك الشركاء حماية قانونية شاملة عن طريق وضع قيود وإجراءات قانونية قبل البناء وأثنائه وحدد مسؤولية كل شخص من أشخاص هذه الملكي نتيجة العلاقة التي تربطهم، و خول لكل واحد منهم حق التقاضي في حالة نشوب نزاع و ذلك وفق إجراءات قانونية محددة و التي تتم لدى المحكمة التي يقع عليها العقار. الكلمات المفتاحية: الأجزاء المشتركة، الملكية المشتركة، حق التقاضي . Abstract: Joint real estate ownership has a special real estate status in which the built properties are divided between several people according to shares. Each share contains a special part that is unique to the owner, such as an apartment, and a share in the common parts, such as the walls, which cannot be the subject of a partition lawsuit or a sale by auction, in isolation from the private parts. To ensure the proper management and preservation of joint property, the legislator established mechanisms. It also granted the co-owners comprehensive legal protection by setting restrictions and legal procedures before and during construction.
