الحماية القانونية للملكية العقارية الغابية في التشريع الجزائري

إن الأهمية الاقتصادية والاجتماعية والبيئة للأملاك العقارية الغابية، دفعت المشرع الجزائري إحاطة هذه الأملاك بحماية قانونية خاصة، سواء بموجب قانون الغابات 84-12 باعتباره التشريع الأساسي الناظم لهذه الأملاك وكذلك بموجب القوانين الأخرى، سيما القانون 30-90 المتضمن الأملاك الوطنية و القانون 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة، بالإضافة إلى كل من القانون المدني وقانون العقوبات. وإننا بالرجوع إلى هذه النصوص القانونية، نجدها تتضمن نوعين من الحماية المقررة يسمى للأملاك العقارية الغابية، فإما أن تكون الحماية قبلية تهدف إلى تجنب وقوع الأضرار أو ما بالحماية الوقائية، وإما أن تكون الحماية بعدية تهدف لإصلاح وتثمين الثروة الغابية أو تسليط العقاب. على المخالفين والمتسببين في إلحاق الضرر بها، أو ما يسمى بالحماية العلاجية. الكلمات المفتاحية: 1- الأملاك الغابية 2- الوقاية /3-المخالفات /4- الملكية العقارية 5/ الحماية. Abstract Due to the economic, social and environnemental importance of the forest properties, the Algerian legislator had to wrap this kind of property with a special legal protection, whether under the 84/12 forest Act which is regarded as the fundamental legislation regulating these properties, or under other laws, particularly the 90/30 Act which protects the national properties and the 03/10 Act on the protection of the environment in the context of sustainable development, in addition to the Civil Law and the Penal Law. And by referring to these legal texts, we can find that they include two types of forest property protection, either a proactive protection aiming to avoid the damage on forests or the so-called preventive protection, or a reactive protection aiming to remedy and value the forest wealth or inflict a punishment on violators and the perpetrators of the damage to these properties, or the socalled therapeutic or remedial protection keywords: 1/Forest property 2/ protection 3 / Irregularities 4 Real estate ownership 5/ Protection
