لم يتطرق المشرع الجزائري لهذا الموضوع بصفة دقيقة كان لابد من الاستعانة بالفقه والقضاء الفرنسي اللذان قدما اهتماما كبيرا للالتزام بالنصيحة باعتباره التزاما مستقل بذاته. وتأسيسا على ما تقدم يعتبر هذا الموضوع اتفاقا بين شخصين أحدهما مهني يقال له المستشار وهو شخص متخصص في فرع من فروع المعرفة الفنية يلتزم بمقتضاه في مواجهة طرف آخر يقال له العميل مقابل بدل أتعاب أن يقدم على وجه الاستقلال استشارة أو دراسة و هي خدمة ذات طبيعة ذهنية من شأنها أن تؤثر بطريقة فعالة في توجيه قرارات العميل. ABSTRACT : The Algerian legislatordid not addressthissubjectprecisely, and itwasnecessary to seek the help of French jurisprudence and the judiciary, whichpaidgreat attention to the commitment to advice as an independent obligation. Based on the foregoing, thissubjectisconsidered an agreement betweentwopersons, one of whomis a professionalcalled a consultant, a personspecialized in a branch of technicalknowledge, underwhichheisobligated in the face of another party whoistold the client for a fee to provideindependently a consultation or study, whichis a service of a mental nature thatwill affect in an effective way in directing the client'sdecisions.
