بما ان السياحة اضحت من ضرورات العصر فقد طالها الغزو التكنولوجي ومخرجاته ما ادى الى التخلي عن العقود السياحية الكلاسيكية القديمة و ظهور ما يعرف بالعقود الإلكترونية للخدمات السياحية، أو العقد الإلكتروني السياحي. يعتبر القطاع السياحي أحد أهم المجالات التي تحتاج إلى التكنولوجيا الحديثة نظرا لما يتميز به عن غيره من القطاعات الأخرى. كما أن الانتشار الواسع والسريع لهذا النوع من العقود سيما العقد الإلكتروني السياحي، إستوجب على المشرع الدولي وكذلك المحلي إستحداث نصوص وتشريعات على مستويين، تنظم هذه العقود وتحفظ بها حقوق الأطراف وتمنع ظهور الفوضة بتعامل بها. الكلمات المفتاحية: السياحة، الخدمة السياحية، عقد البيع الإكتروني. Abstract Sincetourism has become one of the necessities of the times،it has been affected by the technological invasion and its outputs،whichled to the abandonment of the oldclassicaltourismcontracts and the emergence of whatisknown as electroniccontracts for tourism services،or the tourismelectroniccontract. The tourism sector is one of the most important areas that need modern technology due to its distinction from other sectors. The wide and rapid spread of this type of contract،especially the tourism electronic contract،necessitated the international as well as local legislators to develop texts and legislation at two levels،regulating these contracts،preserving the rights of the parties and preventing the emergence of chaos by dealing with them.
