الضوابط القانونية لرخصة البناء على الأراضي الفلاحية في الجزائر

تعتبر رخصة البناء الخاصة بالاراضي الفلاحية آلية حقيقية من أجل حماية هذا الصنف من العقار، وفي نفس الوقت هي أداة لخلق التوازن بين ضرورة المحافظة على الارض وضرورة إثمارها وإستغلالها بشكل أنجع وأجدى. في حين تعرضت الكثير من الاراضي الفلاحية الى سوء التسيير والاستغلال وتم تحويل وجهتها الفلاحية الى أراضي عمرانية. ولهذا حرص القانون على حماية هذا العقار وضع مجموعة من الضوابط القانونية وتنظيمية صارمة تمنع البناء على هذا الوعاء وتكفل المحافظة عليه لاستعماله في الاغراض الزراعية البحثة، غير أنه في بعض الاحيان وتحت ظروف قاهرة تدعو الحاجة الى إقامة بناءات فوق العقارات الفلاحية لوجود مصلحة جديرة بالرعاية ونتيجة لذلك فرض شروط خاصة لمنح رخصة البناء على الاراضي الفلاحية سواء من حيث صفة طالبها أو من خلال مساحة الاراضي الفلاحية الدنيا المسموح بالبناء عليها، والمساحة القصوى للمباني والمنشآت. الكلمات المفتاحية : رخصة البناء، الاراض الفلاحية، الضوابط القانونية Abstract The building permit for the farming lands is a real mechanism for protecting this item from the real estate. At the same time, it is a tool to create a balance between the need to preserve the land and the need to produce and exploit it more effectively and efficiently. While many peasant lands were subjected to mismanagement and exploitation and their destination was converted into urban lands. For this reason, the law ensures the protection of this property and establishes a set of strict legal and regulatory controls that prevent the construction of this pot and ensure its preservation for use in agricultural research purposes. Sometimes, however, under compelling circumstances, construction needs to be built on the farming estates because there is a worthy interest. As a result, special conditions have been imposed for the granting of a building permit on the peasant land, both in terms of the applicant's status and through the minimum area of peasant land permitted for construction, and the maximum space for buildings and installations.
