يُعد عقد الوكالة من أبرز الوسائل القانونية التي تسير التعاملات اليومية بين الأفراد، حيث يسمح هذا العقد بتفويض المهام ضمن حدود معينة وجب على الطرفين التقيد بها. رغم أن المشرع الجزائري قد نظم أحكام هذا العقد ضمن لقانون المدني، واضعًا إطارًا عامًا يستند إلى القواعد التقليدية للعقود من حيث الأركان والآثار والانقضاء، إلا أن ذلك غير كافي خاصةفيما يتعلق بتحديد المسؤوليات بدقة، إضافة إلى غياب تنظيم تفصيلي لبعض المسائل المستحدثة كتعدد الوكلاء، أو التصرفات الإلكترونية، مما يستدعي تدخلًا تشريعيًا لتحديث النصوص بما يتلاءم مع متطلبات العصر. The agency contract is considered one of the most prominent legal tools that facilitate daily transactions between individuals. This contract allows for the delegation of tasks within specific boundaries that both parties must adhere to. Although the Algerian legislator has regulated the provisions of this contract within the Civil Code—establishing a general framework based on traditional contractual principles in terms of formation, effects, and termination—this remains insufficient. In particular, there is a lack of precise delineation of responsibilities, as well as the absence of detailed regulation for emerging issues such as the appointment of multiple agents or electronic transactions. These shortcomings call for legislative intervention to update the legal texts in a manner that aligns with the demands of modern times.
