كانت المعطيات الشخصية إلى غاية السنوات الأخيرة عرضة للاعتداء لولا الاستغلال الواسع للمعلوماتية في مجال إنشاء الملفات المتعلقة بها و عالجتها بطريقة ألية، إذ أن هذه الطريقة سهلت إمكانيات الحصول عليها وتنظيمها والتصرف فيها، مما قد يؤدي أحيانا إلى إنجاز كل هذه العمليات بشكل غير مشروع، و قد بقى هذا الفراغ القانوني إلى غـــــاية صدور القانون رقم 18-07 المؤرخ في 10 يونيو 2018، المتعلق بحماية الأشخاص الطبعين في مجال معالجة المعطيات ذات الطابع الشخصي، والهدف منه تأطير الحماية القانونية للحياة الخاصة للأفراد والحفاظ على سمعتهم و شرفهم وكرامة عائلاتهم، و الذي يشترط الموافقة الصريحة للشخص المعني لاستعمال معطياته الشخصية تماشيا مع مبادئ الدستور الجزائري، هذا القانون تناول من خلال مواده المبادئ الأساسية لحماية المعطيات ذات الطابع الشخصي والتي تسهر على تطبيقها السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي، حيث تتمتع هذه الأخيرة بمجموعة من الصلاحيات تسمح لها بتطبيق أحكام إدارية وأحكام جزائية للحفاظ على خصوصية المعطيات الشخصية. Summary Untilrecentyears, personal data would not have been vulnerable to attackwereit not for the widespread use of information technology to create and automate files related to it. This approach has facilitatedaccess, organization, and management of such data, whichcansometimes lead to the unlawfulconduct of theseoperations.This legal vacuum remained in place until the issuance of Law No.18-07 of10June 2018, concerning the protection of naturalpersons in the processing of personal data. The lawaims to frame the legal protection of individuals' privatelives and preservetheir.reputation, honor, and the dignity of theirfamilies. It requires the explicit consent of the personconcerned for the use of theirpersonal data, in accordance with the principles of the Algerian Constitution. This law, throughits articles, addresses the basic principles of personal data protection, which are enforced by the National Authority for the Protection of Personal Data. The latter enjoysa set of powersthatallowit to apply administrative and criminal provisions to preserve the privacy of personal data.
