إن التطور الحاصل في جمال التكنولوجيا ، جعل الاساليب التقليدية في ابرام المعاملات لا تتلائم مع هذا المجال،مما أدى الى البحث عن أساليب أكثر ملائمة ومحل ثقة بين الاطراف، فظهر التوقيع الالكتروني كبديل عن التوقيع التقليدي وكأهم وسيلة للاثبات في التعاملات التي تتم عبروسائط الكترونية التي تفتقد للحضور اللامادي للاطراف والعلاقة المباشرة بين بينهم، ونظرا للاهمية التي يلعبها التوقيع الالكتروني في استقرار المعاملات فقد لقي اهتمام التشريع والفقه في تعريفه و تنظيم أحكامه وأعطيت له الحجية القانونية وفقا للشروط المحددة كما أوجب اليات حمايته وتقررت عقوبات للجرائم المتصلة به. Absract: The development in the field of technology has made the traditional methods of concluding transactions incompatible with this field. Which led to the search for more appropriate and reliable methods between the parties. The electronic signature appeared as an alternative to the traditional signature and as the most important means of proof in transactions that take place through electronic media that lack the physical presence of the parties and the direct relationship between them. Given the importance that the electronic signature plays in the stability of transactions, it has Legislation and jurisprudence received attention in defining it and regulating its provisions. It was given legal authority in accordance with the specified conditions. It also required mechanisms to protect it, and penalties for crimes related to it were decided.
