الدليل الرقمي و دوره في الإثبات الجنائي

يعد الدليل الرقمي من وسائل الاثبات الأساسية في القضايا الجنائية المعاصرة، نظرا لتزايد الجرائم المرتبطة بالتكنولوجيا. و لقد اعترفت اغلب التشريعات الحديثة بحجيته سيما المشرع الجزائري ، بشرط ان يتم جمعه بطريقة مشروعة و من جهة مختصة ، مع ضمان سلامته من التلاعب او التحريف، و كذلك احترام الضوابط الفنية و الاجرائية أثناء عملية استخلاصه. و لقد منحت للقاضي الجنائي حرية الاقتناع الشخصي بأي دليل مطروح أمامه ، و هذا المبدأ من شأنه أن يسمح باستخدام واسع للأدلة العلمية الحديثة، إلا أن المشرع لم يترك هذه الحرية مطلقة دون حدود، بل قيدها بأن أخضعها لضوابط بعضها منصوص عليه في القانون و الآخر مقرر ضمن المبادئ العامة لضمان حجية الدليل الرقمي وفق القانون ، و منع المساس بضمانات المحاكمة العادلة. Abstract : Digital evidence is considered one of the fundamental means of proof in contemporary criminal cases, due to the increasing prevalence of technology-related crimes. Most modern legal systems have recognized its evidentiary value, including Algerian legislation, provided that it is collected lawfully and by a competent authority, while ensuring its integrity against tampering or alteration, and complying with both technical and procedural safeguards during its extraction. Although criminal judges are granted discretionary power to evaluate any evidence presented before them—based on the principle of free evaluation of evidence—this freedom is not absolute. The legislator has imposed certain limitations, both statutory and grounded in general legal principles, to ensure the reliability and admissibility of digital evidence in accordance with the law and to safeguard the guarantees of a fair trial.
