إن إجراءات البحث والتحقیق في الجنائي العام هي الأساس في البحث والتحقیق في جرائم الالكترونية تماما كما هو الحال في باقي الجرائم الأخرى، أما عناصر البحث والتحقیق الجنائي الأخرى من عملیة وفنیة وغیرها فإن استخدامها یتوقف على ظروف كل جریمة، فلما اعتمد المشرع الجزائري نصوصا لتجريم الأفعال الواقعة في الوسط الإلكتروني والمستخدم فيها الأجهزة الإلكترونية وكل ما يمس المعالجة الألية للمعطيات بمفهوم الجريمة الإلكترونية مما استدعى المشرع الجزائري الى ادخال مجموعة من التعديلات على كل من قانون العقوبات وقانون الاجراءات الجزائية، كما استحدث القانون 09-04 المتعلق بالقواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الاعلام والاتصال ومكافحتها، اضافة الى القانون 18-04 المتعلق بالقواعد العامة للبريد والاتصالات الالكترونية، والقانون 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي. الكلمات المفتاحية: إجراءات التحقيق الإلكتروني، الجريمة الإلكترونية، التفتيش، التسرب، الترصد الإلكتروني.
