هذه الدراسة إلى تحليل الإطار القانوني لحماية المستهلك الإلكتروني في التشريع الجزائري، من خلال التطرق إلى الجوانب النظرية للمستهلك في البيئة الرقمية، وتبيان مبررات وضرورات توفير حماية فعالة له. كما تناولت الدراسة حماية المستهلك عبر قانون التجارة الإلكترونية وقانون العقوبات، مسلطةً الضوء على الضمانات القانونية في مراحل التعاقد الإلكتروني، والحماية من الجرائم الإلكترونية مثل الغش والخداع. وقد خلصت إلى أن الحماية الحالية غير كافية، مما يستدعي تطوير نصوص أكثر تكاملًا وتفعيل الآليات الرقابية والإدارية والقضائية. كلمات المفتاحية: حماية المستهلك الإلكتروني – التشريع الجزائري – التجارة الإلكترونية. This study aims to analyze the legal framework for the protection of electronic consumers under Algerian legislation, by exploring the theoretical aspects of consumer rights in the digital environment and the need for effective safeguards. It examines the protection mechanisms outlined in the Electronic Commerce Law and the Penal Code, highlighting legal guarantees during e-contracting and protection against cybercrimes such as fraud and deception. The study concludes that the current protection is insufficient and calls for more comprehensive laws and stronger oversight mechanisms.
