حماية حقوق المؤلف من القرصنة الإلكترونية

يطرح البحث إشكالية حماية حق المؤلف في المؤلفات متعددة الوسائط في التشريع الجزائري والاتفاقيات الدولية، في ظل التحديات القانونية والأخلاقية إزاء النشر والتداول الواسعين للمنتج الفكري والأدبي والفني في البيئة الرقمية دون مراعاة حقوق المؤلف والحقوق المجاورة. ونظرا لخصوصية المؤلفات الرقمية المنتجة بصيغة الوسائط المتعددة؛ يمكن وصف مسألة تصنيفها وحمايتها بالصعبة مع ما تطرحه الإنترنت اليوم من سهولة في النشر والتصفح. واعتمدنا على المنهج الوصفي التحليلي المناسب لتحقيق أهداف البحث الرامية إلى التعرف على توافق القوانين والاتفاقيات الدولية والتشريع الجزائري مع التطور التكنولوجي في مجال توفير الحماية القانونية لحقوق التأليف في المصنفات الرقمية، ولا سيما المؤلفات متعددة الوسائط. كما استخدمنا أداتي الملاحظة والتحليل الوثائقي للقوانين والمراجع والدراسات التي تناولت الموضوع. وتوصل البحث إلى أن حقوق المؤلف والحقوق المجاورة في مصنفات الوسائط المتعددة لم تحظ بالعناية والاهتمام الدقيقين في الاتفاقيات الدولية وفي التشريع الجزائري ولا سيما الأمر 03/05 المتعلق بحق المؤلف والحقوق المجاورة، وقدمنا مقترحات أهمها؛ ضرورة تحيين الترسانة القانونية الناظمة لمجال الملكية الفكرية في البيئة الرقمية بما يكفل حق المؤلف والحقوق المجاورة بشكل عادل ومنصف. ودعوة المشرع الجزائري لإشراك متخصصين في مجال التكنولوجيات الحديثة، والتطبيقات الرقمية وتطبيقات الوسائط المتعددة، والوسائط المتعددة التفاعلية للوصول إلى تحديد الطبيعة القانونية لهذه المصنفات بشكل دقيق حتى تكفل حقوق المؤلفين بصفة عادلة تضع حدا أمام استغلال مصنفاتهم على شبكة الانترنت بصفة غير قانونية ولاأخلاقية . Abstract: The research raises the problem of copyright protection in multimedia literature in Algerian legislation and international conventions, given the legal and ethical challenges to the widespread dissemination, circulation of intellectual, literary and artistic product in the digital environment without regard to copyright and related rights. Given the specificity of digital multimedia literature, the issue of classifying and protecting them can be described as difficult with the ease of publishing and browsing that the Internet poses today. We have relied on the appropriate analytical descriptive approach to achieve research objectives aimed at identifying the compatibility of international laws, conventions and Algerian legislation with technological development in providing legal protection for copyrights in digital works, particularly multimedia literature. We also used my observation tools and documentary analysis of laws, references and studies on the subject. The research found that copyright and related rights in multimedia works did not receive careful attention and attention in international conventions and in Algerian legislation, particularly copyright and related rights, and we made proposals :the legal arsenal governing the intellectual property field in the digital environment must be revived to ensure copyright and neighboring rights fairly and equitably. The Algerian legislator's call for the involvement of specialists in modern technologies, digital applications, multimedia applications and interactive multimedia to reach out to determine the exact legal nature of these works in order to ensure the rights of authors fairly puts an end to the illegal and immoral exploitation of their works on the Internet.
