حماية حق الملكية العقارية في التشريع الجزائري

لقد دفعت الصعوبات التي واجهت السلطات العمومية غداة الاستقلال في ميدان العقار، إلى وضع الملكية العقارية في قلب السياسة الاقتصادية والاجتماعية للجزائر و جعل ملكية الأراضي و تسييرها موضوع كافة الاهتمامات كما أن الوقوف على المقصود الحقيقي لتعيير " الملكية العقارية " يقتضي التطرق الى تعريف العقار والملكية ، فالعقار هو الشيء الثابت في مكانه ، و لا يمكن نقله من مكان الى آخر بدون تلف أو تغيير في شكله ، و عرفه المشرع الجزائري في المادة 683 من القانون المدني بأنه كل شيء مستقر بحيزه و ثابت فيه ، متصل بالأرض اتصال قرار . أما الملكية فعرفها المشرع الجزائري في المادة 674 مدني و هي حق المتمتع و التصرف في الأشياء ، يشترط أن لا تستعمل استعمالا تحرمه القوانين والأنظمة أما الملكية العقارية فعرفها المشرع الجزائري في المادة 27 من قانون التوجيه العقاري رقم 90/ 25 المؤرخ في 25/ 11/ 1990. الكلمات المفتاحية: العقار، الملكية العقارية، الحماية القانونية، جرائم العقار. ABSTRACT : The difficultiesfaced by the public authoritiesafterindependence in the field of real estate have prompted to put real estateownership at the heart of Algeria'seconomic and social policy and make land ownership and management the subject of all concerns, and standing on the real intention of calibrating "real estateownership" requiresaddressing the definition of real estate and ownership, as real estateis the thingfixed in its place, and itcannotbemovedfrom one place to anotherwithout damage or change in itsform, and the Algerian legislatordefinedit in the article 683 of the Civil Code thateverythingis stable in itsspace and fixed in it, connected to the land by decisionconnection. As for property, itwasdefined by the Algerian legislator in Article 674 of the Civil Code, whichis the right of the enjoyer and the disposal of things, providedthatitis not used in a wayprohibited by laws and regulations, while real estateownershipisdefined by the Algerian legislator in Article 27 of the Real Estate Directive Law No. 90/25 of 25/11/1990.
