لقد العقود الإلكترونية شكلت تحولاً واضحاً في مجال قواعد التعاقد التقليدية، التراضي هو توافق إرادتين بغرض إحداث أثر قانوني،مما أثار العديد من الإشكالات القانونية، لعل أهمها تلك المتعلقة بمسألة وجود التراضي في هذه العقود، والذي يعد ركناً أساسياً لتكوين العقد بصفة عامة، لا سيما في ظل تميز هذه العقود بالطابع الدولي؛ كونها تبرم عن بعد، وفي بيئة افتراضية لامادية. هذا الوضع دفع العديد من المشرعين إلى تعديل قوانينهم، حتى تستوعب هذا النوع الحديث من العقود، أو استحداث قوانين خاصة بها. ورغم تأخر المشرع الجزائري، إلا أنه أصدر قانوناً خاصاً بالتجارة الإلكترونية. الكلمات المفتاحية: الإيجاب ، القبول، التراضي، العقد الإلكتروني، التجارية الإلكترونية. ABSTRACT: Electronic contracts have marked a clear shift in the field of traditional contracting rules. Consent is the agreement of two wills for the purpose of creating a legal effect. This has raised numerous legal issues, perhaps the most significant of which relates to the issue of the presence of consent in these contracts, which is a fundamental pillar of contract formation in general, especially given the international nature of these contracts, as they are concluded remotely and in a virtual, non-physical environment. This situation has prompted many legislators to amend their laws to accommodate this new type of contract, or to create special laws specifically for it.
