تعتبر المعاملات التجارية روح الاقتصاد في كل زمان ومكان، لأنها تعمل على تداول رؤوس الأموال في المجتمع مما يساعد على النمو الاقتصادي وازدهار الحياة الاجتماعية والمعاملات التجارية، كما يكون فيها الربح الوفير، فالتاجر سواء كان شخصا طبيعيا أو معنويا قد تضطرب أحواله المالية ويؤدي ذلك إلى عدم قيامه بأعماله التجارية ولا يستطيع الوفاء بالديون التي يتحملها تجاه الاخرين، مما يؤثر على حياته التجارية ويتعرض إلى شهر إفلاسه. ومنه يعتبر الافلاس نظام له مكانته في المعاملات التجارية وذلك لما يحققه من أهداف تعود على المدين والدائن والنشاط التجاري على حد سواء، وذلك تماشيا مع ما عرفته الجزائر في الفترة الاخيرة من تحول خاصة في الميدان السياسي والاقتصادي والاجتماعي. الكلمات المفتاحية: الافلاس، الشركات التجارية،المدين،الدائن، القانون التجاري. Abstract: Commercial transactions are considered the soul of the economy at all times and places, because they work on the circulation of capital in society, which helps economic growth and prosperity of social life and commercial transactions, as well as abundant profit. He carries out his commercial activities and cannot pay off the debts he incurs towards others, which affects his commercial life and exposes him to bankruptcy. From him, bankruptcy is considered a system that has its place in commercial transactions, because of the goals it achieves that benefit the debtor, the creditor, and the commercial activity alike, in line with what Algeria has known in the recent period of transformation, especially in the political, economic and social field.
