إن الموارد البيولوجية المتعلقة بالوسط البحري والقابلة للاستغلال،سيما ما تعلق منها بالثروة السمكية، بالرغم من أنها متجددة إلا أنها لاتتحمل الاستغلال المستمروالمكثف لها خاصةالاستغلال الذي غالبا ماتتخلله خروقات لأحكام القوانين المنظمة له،الأمرالذي أصبح يشكل تهديداعلى ديمومة هذه الموارد من حيث وجودها وتجددها، خاصة فيما نادت به الالتزامات الدولية للدولة الجزائرية،وذلك بمناسبة الاتفاقيات الدوليةالتي أبرمتها الجزائروانظمت إليها ،وعليه وحفاظا على هذه المواردا لبيولوجية ولضرورة حمايتها وتقنين استغلالها،اتجه المشرع الجزائري إلى إصدارالقانون رقم 01/11 المؤرخ في 03/07/2001 المتعلق بالصيد البحري وتربية المائيات،والمعدل بموجب القانون 15/08 الصادربتاريخ 02 أبريل 2015 وكذا مجموعة من المراسيم والقرارات التنظيمية المتعلقة بكيفية تطبيق بعض النصوص القانونية،وعليه واعتماداعلى هذه النصوص القانونيةالجديدة،وفي إطارموضوعنا المتعلق خاصة بالضوابط القانونية التي تحكم الوسط البحري،والمحافظة على ثرواته. الكلمات المفتاحية الحماية القانونية – الثروة المائية – القانون الجزائري Abstract The biologicalresourcesrelated to the marine environment and exploitable, especiallythoserelated to fisheries, althoughthey are renewable, do not toleratecontinuous and intensive exploitation of them, especially exploitation, whichisoftenpunctuated by violations of the provisions of the lawsregulatingit, which has become a threat to the sustainability of theseresources in terms of their existence and renewal, especially in whatiscalled for by the international obligations of the Algerian state, on the occasion of the international conventions concluded by Algeria and acceded to, and accordingly In order to preservethesebiologicalresources and the need to protectthem and regulatetheir exploitation, the Algerian legislator has tended to issue Law No. 01/11 of 03/07/2001 on fisheries and aquaculture, as amended by Law 15/08 of April 02, 2015, as well as a set of decrees and regulatorydecisions on how to apply certain legaltexts, and accordingly, based on these new legaltexts, and within the framework of oursubjectrelated in particular to the legalcontrolsgoverning the marine environment, and Preservation of itswealth.
