عقد المقاولة هو اتفاق خاص بين متعاقدين وهما المقاول ورب العمل، وكل له حق وعليه التزام ويختلف الاتفاق والدور حسب نوع المقاولة، يقوم العقد على البنود المتفق عليها ضمنه بهدف إنجاز محلها المطلوب، وتنقضي بأحكام الانقضاء الخاصة بها التي نظمها المشرع الجزائري، وإن لم تحدد أو لم يتم الاتفاق عليها من طرف المتعاقدين يتم اللجوء إلى الأحكام العامة لذلك. الكلمات المفتاحية: عقد المقاولة، المشرع الجزائري، رب العمل، المقاول. Summary The contraction contract is a special agreement between two parties namely the contractor and the employer, each with right and obligation, the agreement and the role vary depending on the type of contract.
