خصوصية التصديق الالكتروني في القانون الجزائري

Abstract

إن التحول من المعاملات الورقية إلى المعاملات الالكترونية حمل في طياته العديد من الإيجابيات التي تخدم الجانب الإداري و مستخدمي الوسائط الإلكترونية خاصة في مجال الإجراءات التعاقدية ، حيث قلت التكلفة و الجهد وأزاحت الجانب الحضوري للأطراف... هذه الايجابيات رافقتها مخاطر عديدة شكلت تهديدا على أمن المعلومات ، فكونها تتم في بيئة افتراضية و بين غائبين جعل ضمانات سلامة التبادل المعلوماتي ضئيلة مما يعرضه لسوء الاستغلال والانتهاك، الأمر الذي فرض على التشريعات خلق آليات لحماية البيانات و المعلومات و الوثائق المتعلقة بأي معاملة الكترونية. والتصديق الإلكتروني يعد من أبرز آليات الحماية التي نصت عليها التشريعات ومن بينهم المشرع الجزائري حيث أصدر بشأنه قانون ينظم قواعده الى جانب التوقيع الإلكتروني وهو القانون 15_04 والذي يعتبر اهم القوانين التي واكب بها المشرع الجزائري المعاملاتالالكترونية. إن الهدف من دراسة موضوع التصديق الإلكتروني يكمن في معرفة خصوصيته بالنسبة للقانون الجزائري و حسب ما تم التطرق إليه في هذه الدراسة نجد أن المشرع الجزائري اهتم و بعناية في إصدار قواعد التصديق الالكتروني و اعتبره وسيلة أمان حيث يقوم بخدماته طرف ثالث موثوق هو مؤدي خدمات التصديق الإلكتروني يقوم بإصدار شهادة تصديق الكترونية تأكد صحة بيانات التعاملات و تنسب التوقيع لصاحبه .كما تحدد لهم التزامات و يترتب عند مخالفتها مسؤوليات وقد حددت لهم عقوبات مالية و إدارية و أخرى جزائية في حال ارتكاب أفعال غير مشروعة يجرمها القانون، ومن هنا نصل إلى نتيجة مفادها أن المشرع الجزائري قد وفق في وضع قواعد تضبط التصديق الالكتروني و تضمن حمايته. الكلمات المفتاحية: التصديق الإلكتروني، التوقيع الإلكتروني، شهادة التصديق الإلكتروني، سلطات التصديق الالكتروني، مؤدي خدمات التصديق الإلكتروني. As ittakes place in a virtualenvironment and amongabsentees, the guarantees of the safety of information exchange are minimal, which exposes it to abuse and violation, which has imposed on legislation to createmechanisms to protect data, information and documents related to anyelectronic transaction. And electronic certification is one of the mostprominent protection mechanismsstipulated by the legislation, including the Algerian legislator, whereheissued a lawregulatingitsrules in addition to the electronic signature, whichis Law 15_04, whichisconsidered the most important lawswithwhich the Algerian legislatoraccompaniedelectronic transactions. The aim of studying the subject of electronic certification lies in knowingitsprivacy in relation to Algerian law. It issues an electronic certification certificatethatconfirms the validity of the transaction data and attributes the signature to itsowner. It alsodefines obligations for them and entailsresponsibilitieswhenthey are violated.
