حدود حجية المحرر الإلكتروني في الإثبات في التشريع الجزائري

Abstract

أدت الثروة التكنولوجية الهائلة إلى اتساع دائرة المعاملات وانتقالها من الطابع التقليدي إلى الطابع الإلكتروني، ولزرع الثقة بين المتعاملين والحفاظ على استقرار المعاملات، حرص المشرع الجزائري على إعطاء المحررات الإلكترونية قوتها الإثباتية،وذلك من خلال ترسانة من القوانين والمراسيم التنفيذية على رأسها تعديل القانون المدني لسنة 2005 كإطار عام والقانون 15- 04 المتعلق بالتوقيع والتصديق الإلكتروني كإطار خاصّ. حيث يهدف بحثنا هذا إلى تبيان حدود حجية المحرر الإلكتروني في الإثبات، إذ اعتمدنا في الوصول إلى ذلك على منهجين هما، المنهج الوصفي والمنهج التحليلي. ويمكن القول أن المشرع الجزائري يسعىلمواكبة التطورات التي يفرضها الواقع العملي في الانتقال من الواقع الملموس المادي إلى الواقع الافتراضي أو البيئة الرقمية. الكلمات المفتاحية: المحررات الإلكترونية-التوقيع الإلكتروني - مبدأ التعادل الوظيفي- جهة التصديق الإلكتروني -شهادة التصديق الإلكتروني. Abstract : The vast technological wealth has led to the expansion of the circle of transactions and their transition from traditional to electronic, and to cultivate trust among customers and maintain the stability of transactions, the Algerian legislator was keen to give electronic editors their evidentiary power, through an arsenal of laws and executive decrees, chief among them the amendment of the Civil Code 2005 as a general framework and law 15-04 on signature and electronic ratification as a special framework. Our research aims to show the limits of the e-editor's authority in proof, as we have relied on two approaches: descriptive and analytical. It can be said that the Algerian legislator seeks to keep up with the developments imposed by practical reality in the transition from physical reality to virtual reality or the digital environment.
