المسؤولية المدنية للمحافظ العقاري في التشريع الجزائري

Abstract

المحافظة العقارية، كأداة قانونية لتكريس السياسة العقارية للدولة الجزائرية.والمحافظة العقارية هيئة إدارية عمومية تزاول مهامها تحت وصاية وزير المالية ويتولى مهام تسييرها محافظ عقاري، تتمثل مهمته الأساسية في حماية الملكية العقارية والمعاملات الواردة عليها. ومثلما منح المشرع الجزائري السلطة الكاملة للمحافظ العقاري في تولي تسيير المحافظة العقارية، إلا أن ذلك لم يمنع من خلو مهنته من الأخطار والمشاكل نظرا لدقة عملية شهر العقود والتسيير الإداريللمصلحة، زيادة على كونه مسؤل عن حماية حقوق الأفراد وممتلكاتهم،وأيضا كونه يعتبر محاسب عمومي قانوني.
