آليات حماية براءة الإختراع وفقا للتشريع الجزائري

Abstract

يتضح من خلال دراستنا لموضوع الحماية القانونية لبراءة الاختراع في التشريع الجزائري على ضوء أحكام الأمر03-07 المتعلق براءة الاختراع، هذه الأخيرة من المواضيع التي لقيت اهتماما كبيرا لدى الباحثين القانونين والاقتصاديين نظرا لما لها من آثار إيجابية علىاقتصاديات الدول. كما تم تسليط الضوء على الشروط والضوابط الموضعية والشكلية والتي بموجبها يتم منح البراءة من طرفالسلطات المعنية. ويترتب على صدور براءة الاختراع آثار نظمها المشرع الجزائري من حيث الحقوق التيتحولها البراءة لمالكها كالحق في الاحتكار الحق في التصرف بجميع التصرفات القانونية ونظم لها التزاماتالتي تترتب على عاتق مالكها وهذا من أجل الاستفادة بقدر كبير من البراءة رغم ذلك قد تنقضي براءة الاختراعلعدة أسباب. كما أقر المشرع الجزائري صراحة حق مالك البراءة في احتكار استغلالها ولحماية الحق نص علىحماية جزائية وأخرى مدنية، هذه الأخيرة تعطى له الحق في التعويض فيجوز له رفع دعوى المنافسة غيرالمشروعة، أما بالنسبة للحماية الجزائية فقد حدد المشرع الأفعال التي تشكل اعتداء على براءة الاختراع مثل جريمة التقليد. أما على المستوى الدولي فقد تم تكريس اتفاقيات و معاهدات دولية، بدءا من اتفاقية باريس وصولا إلى اتفاقية تربس .

Abstract of The master thesis It is evident through our study of the subject of legal protection for a patent in the Algerian legislation in light of the provisions of Ordinance 07_03 related to the patent, as it is one of the topics that has received great interest among legal and economic researchers due to its positive effects on the economies of countries. The local and formal conditions and controls under which the patent is granted by the concerned authorities were also highlighted. The issuance of the patent entails the effects organized by the Algerian legislator in terms of the rights that the patent confers on its owner, such as the right to monopolize, the right to act in all legal actions and systems for it, the obligations of its owner, and this is in order to benefit from a large amount of the patent. However, the patent may expire for several reasons. The Algerian legislator also explicitly acknowledged the right of the patent owner to monopolize its exploitation and to protect the right provided for penal and civil protection, the latter giving him the right to compensation, so he may file a lawsuit against unfair competition. As for penal protection, the legislator identified acts that constitute an attack on the patent. Like the crime of imitation.
