حماية المستهلك من السلع المقلدة في التشريع الجزائري

Abstract

يعتبر موضوع حماية المستهلك من أهم المواضيع لكونه يرتبط بفئة واسعة من المجتمع وهي فئةالمستهلكين، حيث أن المستهلك والذي يعتبر أهم عضو في عجلة الاستهلاك يدخل في معامالت تجاريةيومية مع المتدخلين لأجل تلبية حاجياته، مما يجعل منه في الكثير من الأحيان عرضة للغش دونالمراعاة لصحته ومصالحه، ويرجع هذا الى الانتشار الكبير للسلع المقلدة. وحتى يكون المستهلك ضحية لهاته الظاهرة استوجب على المشرع الجزائري تكريس رغبته لحمايةالمستهلك والذي غالبا ما يكون في مركز ضعف في البحث عن آليات وقائية فعالة، وتعزيز محاربة هاتهالسلع المقلدة بإجراءات ردعية من أجلإحداث التوازن.

Résumé : The subject of the safety of consumer is considered one of the most important topics since it is widely related to a large category of the community. The consumer, being a member with producers in order to obtain his desires. This last act makes him exposed to fraud with no consideration to his health and benefits due to the large spread of fraud products In the market. In order to preserve the consumer from falling to such phenomena, it is necessary that the Algerian legislator reinforces the forces to fight imitated products using sever procedures and fosters the consumer protection which can be a weakness in the process.
