الحماية القانونية للملكية الصناعية في التشريع الجزائري

Abstract

إستهدف الدراسة الوقوف على الحماية القانونية الحماية القانونية للملكية الصناعيةفي التشريع الجزائري وحماية حقوق ملكية الصناعية وطنياً هو الأكثر فعالية واتصالاً بالنمو الاقتصادي، حيث تخطى حقوق الملكية الصناعية برعاية وطنية ودولية نظراً للأهمية التي تكتسبها، وتطرقنا إلى الحماية الوطنية في دراستنا هذه تتفرع إلى قسمين رئيسين: الحقوق الواردة على الابتكارات الصناعية الجديدة هو الفصل الاول الإجرائية للملكية الصناعية في التشريع الجزائري ثم الفصل الثاني: الحماية المدنية والجزائية للملكية الصناعية في التشريع الجزائري الذي يتعلق الحماية بالابتكارات من حيث موضوع المنتوجات، أي التي لها طابعاً نفعياً وأهمها هي براءة الاختراع وقد يتعلق ابتكار جديد من حيث شكل المنتوجات أي ابتكارات ذات الطابع الفني وهي الرسوم والنماذج الصناعية، وقد تكون تلك التي تجمع بين الابتكار النفعي والشكل الفني وهي التصميمات الشكلية للدوائر المتكامل. الكلماتالمفتاحية:براءة الاختراع، التصاميم الشكلية والرسوم، النماذج الصناعية، تسميات المنشأ، العلامات.

Abstract: The study aimed to identify the legal protection of industrial property in Algerian legislation and the protection of industrial property rights at the national level as most effective and relevant to economic growth. It went beyond industrial property rights under national and international auspices in view of the importance they assume. In this study, we addressed national protection in two main sections: The rights contained in new industrial innovations are the first procedural chapter of industrial property in Algerian legislation and the second chapter: Civil and penal protection of industrial property in Algerian legislation concerning the protection of innovations in terms of the subject matter of the products, namely, those of a useful nature, the most important of which is the patent. New innovation in terms of the form of the products may relate to any innovations of a technical nature, namely industrial drawings and models.
