الإطار القانوني للتحايل الذكي

Abstract

التحايل الذكي هو إستراتيجية يقوم بها المصنع لتصميم سلع ومنتجات ذات عمر محدود عن قصد وبتخطيط مسبق، هدفها زيادة حجم المبيعات على المدى الطويل ،وبالتالي زيادة في الربح والإنتاج، وتعتبر هذه الإستراتيجية قانونيا من الطرق غير المشروعة ، ذلك أنها تقلل من الجودة والعمر الافتراضي للمنتوج لدفع وإجبار المستهلك على الاستبدال والتغيير ، وهذا ما ألزم بعض التشريعات على التدخل مباشرة كالتشريع الأوروبي والفرنسي من أجل تجريم هذه الظاهرة ، في حين اتجهت بعض التشريعات المقارنة على غرار المشرع المصري والجزائري إلى محاربة الظاهرة عن طريق بعض القوانين الخاصة والأليات الإجرائية لحماية المستهلك بطريقة غير مباشرة . الكلمات المفتاحية: التحايل الذكي، التضليل، الممارسات غير المشروعة، خفض العمر الافتراضي للمنتج، التقادم المخطط، مكافحة الظاهرة. Smart circumvention is a strategy undertaken by the factory to intentionally design commodities and products with a limited life and with prior planning, with the aim of increasing the volume of sales in the long term, and thus an increase in profit and production. And forcing the consumer to replace and change, and this is what required some legislation to intervene directly, such as European and French legislation in order to criminalize this phenomenon, while some comparative legislation, similar to the Egyptian and Algerian legislators, tended to fight the phenomenon through some special laws and procedural mechanisms to protect the consumer indirectly.
