الضمانات القانونية للمستهلك الإلكتروني

Abstract

بالرغم من أن المشرع الجزائري كان متأخرا نسبيا في إصدار القانون رقم: 18-05 المؤرخ في:10 ماي 2018 المتعلق بالتجارة الالكترونية، إلا أنه جاء بضمانات من شأنها حماية المستهلك الإلكتروني من الأخطار التي قد تصيبه خلال تعاقده عبر شبكة الأنترنيت، وذلك من خلال وضع جملة من الشروط التي على المهني التقيد بها بصفته الخبير، فبين سعي المستهلك الالكتروني لإشباع رغباته السلعية والخدمية وسعي المهني إلى الترويج لمنتجاته بمختلف الطرق، يكون القانون هو الضامن الوحيد لبناء التوازن في هذه العلاقة التعاقدية. الكلمات المفتاحية: المورد الإلكتروني، المستهلك الإلكتروني، عقد الإستهلاك الإلكتروني، الضمانات القانونية، التشريع الجزائري. Abstract: Although the Algerian legislator was relatively late in issuing Law No. 05-18 of May 10, 2018 related to electronic commerce, it came with guarantees that protect the electronic consumer from the dangers that may befall him during his contract via the Internet, by setting A number of conditions that the professional must abide by in his capacity as the expert. Between the electronic consumer’s endeavor to satisfy his commodity and service desires and the professional’s endeavor to promote his products in various ways, the law is the only guarantor for building balance in this contractual relationship.
