دور الهيئات الإدارية في حماية البيئة في التشريع الجزائري

Abstract

ان دراسة موضوع دور الهيئات الإدارية في حماية البيئة في التشريع الجزائري يظهر مكانة البيئة لدى المشرع الجزائري حيث تظهر مكانتها في مختلف التشريعات التي تهدف لحمايتها مثل القانون 03-10، والقوانين ذات الصلة مثل قانون تسير النفايات 01-19، ويظهر لنا من خلال البحث اهتمام المشرع بكل مكونات البيئة ومجالاتها من خلال إشراك مختلف الهيئات الإدارية المركزية والمحلية التي تقوم بدورها في حماية البيئة من خلال مهامها العادية، في إطار القوانين التنظيمية المتعلقة بها، التي تضمن حماية للبيئة بطريقة غير مباشرة، وتأكيدا على مكانة البيئة و دور الهيئات الإدارية في حمايتها، منح المشرع الهيئات الإدارية وسائل قانونية وقائية وردعية هدفها الوقاية من الأخطار والأضرار التي تمس بالبيئة وردع الملوثين، بالرغم من توفر الوسائل الإدارية لحماية يبقى موضوع حماية البيئة يتطلب اهتمام أكثر لبلوغ الهدف المنشود، ولا يتحقق ذلك إلا بإشراك المواطن وتوعيته لأنه المتسبب الأول في التلوث. الكلمات المفتاحية: حماية البيئة، الهيئات المحلية، الهيئات المركزية.

Abstract : Studying the topic of the role of the administrative organizations in environment protectionshows the status of the environment in the Algerian legislator, this status appears in different legislations which aim to protect it like the law of 03-10, then the related laws like the law of waste management 01-19. The legislator’s interest in all components of the environment and its fields appears through the research by involving central and local administrative organizations which does its normal role in the protection of the environment within the framework of organizational laws which ensure the environment protection indirectly ,confirmation on the status of the environment and the role of the administrative organizations in the protection, the legislator gave the administrative organizations legal ,preventive and deterrent means which aim to prevent from the dangers and the damages that affect the environment ,then to deter the polluters. Despite the availability of the administrative means, the subject of environment protection still needs more interest to rich the desired goal, and that would not be achieved until involving the citizen and aware him because he is the first involved in the pollution.
