دور الشباك الوحيد في حماية المظهر الجمالي للعمران

Abstract

إن تنظيم المجال العمراني من حيث التخطيط والتنفيذ المحكم لقواعد قانون التهيئة و التعمير و تفعيل آليات الرقابة الإدارية من أجل ضبط النشاط العمراني و الحفاظ على النظام العام العمراني وكذا تفعيل دور رقابة القضاء العادي والإداري لردع المخالفات و الانتهاكات التي يمارسها الأفراد متجاوزين حدود حرياتهم في ممارسات سلطاتهم المشروعة على حق الملكية وكذلك تفعيل دوره في مراقبة أداء السلطات على مختلف المستويات ومدى التزامها بالقانون لخلق موازنة بين المصلحة و الحرية الفردية والمصلحة العامة وحماية النظام العام العمراني كان هذا على مدار الحقب التاريخية للجزائر ترجمتها الترسانة القانونية للمراحل المتعاقبة والتي كانت تعكس التوجهات الإيديولوجية للنظام السياسي ونظرته المجال التهيئة والتعمير وصولا إلى ما جاء به المرسوم التنفيذي 15/19 المحدد لكيفيات تحضير عقود التعمير وتسليمها واستحداث الشباك الوحيد كألية أو إطار قانوني يمكن الإدارة من بسط الرقابة على مجال التهيئة والتعمير وتثمين العقار كألية تمويل اقتصادية واجتماعية وثقافية لما للبناء والهندسة المعمارية من أبعاد تعكس ثقافة و هوية المجتمع. الكلمات المفتاحية:عقود التعمير، التهيئة والتعمير، الشباك الوحيد Abstract: The organization of the urban field in terms of planning and tight implementation of the rules of the Law of Planning and Reconstruction and the activation of administrative control mechanisms in order to control urban activity and maintain urban public order, as well as activating the role of the ordinary and administrative judiciary control to deter violations and violations practiced by individuals exceeding the limits of their freedoms in the exercise of their legitimate powers over the right to property, as well as activating its role in monitoring the performance of authorities at various levels and the extent of their commitment to the law to create a balance between interest and individual freedom And the public interest and the protection of urban public order This was throughout the historical eras of Algeria, translated by the legal arsenal of successive stages, which reflected the ideological orientations of the political system and its view of the field of preparation and reconstruction, leading to what was stated in Executive Decree 15/19 specifying the modalities for preparing and delivering construction contracts and the development of a single window as a mechanism or legal framework that enables the administration to extend control over the field of preparation, reconstruction and real estate valuation as an economic, social and cultural financing mechanism because of the dimensions of construction and architecture that reflect Culture and identity of society.
