يعد شهر إفلاس المدين بمثابة حجز عام لأمواله تمهيدا لتصفيتها وتوزيع ثمنها على الدائنين ويتطلب ذلك العديد من الإجراءات لحصر ذمة المفلس والوصول إلى تفليسة ويعهد بعد ذلك إلى وكيل الدائنين، يطبق عليه الوكيل متصرف قضائي تحت إشرافه ومراقبة القاضي المنتدب وخول للمحكمة التي أصدرت حكمها بـ شهر الإفلاس سلطة الفصل في القضايا الهامة وأجاز للنيابة العامة الإطلاععلى جرائم الإفلاس. إضافة إلى ذلك نجد أشخاص أخرى خارجة عن قطاع القضاء تعتبر من أشخاص التفليسة غير قضائيين وتتمثل في المدينين وجماعة الدائنين بحيث أن المدين في مرحلة الإفلاس تغل يده عن التصرف وإدارة أمواله الحاضرة والمستقبلة ويحل محله الوكيل المتصرف القضائي وحماية الدائنين تدخل في جماعة واحدة الذي كذلك يقوم بتسجيلها وكيل المتصرف القضائي حيث يحرمون منالإجراءات الفردية في التنفيذ على أموال المدين. Summary Declaring the debtor's bankruptcy is considered a general seizure of his funds in preparation for liquidating them and distributing their price to the creditors. This requires many procedures to confine the bankrupt's liability and reach bankruptcy. The debtor is then entrusted to the creditors' agent. The agent applies a judicial administrator over him under his supervision and control of the assigned judge, and the court that issued its ruling is authorized to declare bankruptcy. The authority to adjudicate important cases and authorized the Public Prosecution to review bankruptcy crimes. In addition, we find other persons outside the judicial sector who are considered non-judicial persons in bankruptcy, and they are represented by the debtors and the group of creditors, so that in the stage of bankruptcy the debtor is restricted from disposing of and managing his present and future funds and is replaced by the judicial agent acting and the protection of the creditors falls into one group, which he also registers.
