Abstract

يعد شهر إفلاس المدين بمثابة حجز عام لأمواله تمهيدا لتصفيتها وتوزيع ثمنها على الدائنين ويتطلب ذلك العديد من الإجراءات لحصر ذمة المفلس والوصول إلى تفليسة ويعهد بعد ذلك إلى وكيل الدائنين، يطبق عليه الوكيل متصرف قضائي تحت إشرافه ومراقبة القاضي المنتدب وخول للمحكمة التي أصدرت حكمها بـ شهر الإفلاس سلطة الفصل في القضايا الهامة وأجاز للنيابة العامة الإطلاععلى جرائم الإفلاس. إضافة إلى ذلك نجد أشخاص أخرى خارجة عن قطاع القضاء تعتبر من أشخاص التفليسة غير قضائيين وتتمثل في المدينين وجماعة الدائنين بحيث أن المدين في مرحلة الإفلاس تغل يده عن التصرف وإدارة أمواله الحاضرة والمستقبلة ويحل محله الوكيل المتصرف القضائي وحماية الدائنين تدخل في جماعة واحدة الذي كذلك يقوم بتسجيلها وكيل المتصرف القضائي حيث يحرمون منالإجراءات الفردية في التنفيذ على أموال المدين.
