حجب المواقع الإلكترونية بين الحرية و القانون

تهدف هذه الدراسة والموسومة بعنوان حجب المواقع الإلكترونية بين الحرية والقانون إلى استعراض الأبعاد القانونية والاجتماعية لحجب المواقع الإلكترونية، وتقديم تحليل شامل لمبرراته وتداعياته على حرية التعبير. ، وقد تم الاعتماد في هذه الدراسة على المنهج الوصفي، وكذا الاعتماد بشكل أكبر على التحليل كونه موضوع لم يتطرق إليه كثيرا إلا في الصحافة والمواقع الإلكترونية مع أجبرني على الاعتماد بشكل كبير على الأمثلة من أجل الوصول لإجابة مقنعة للإشكالية المطروحة وكذا طرح توصيات تساعد في إثراء الموضوع. وقد توصلت الدراسة إلى عدة نتائج أهمها ضرورة إيجاد التوازن بين حماية الأمن القومي وضمان حرية التعبير، أي إجراءات حجب يجب أن تكون مبررة بشكل واضح وتنفذ بشفافية لمنع الانتهاكات المحتملة للحقوق الأساسية. بالإضافة إلى أن حجب المواقع الإلكترونية لأسباب سياسية يمكن أن يؤدي إلى قمع الأصوات المعارضة والحد من التدفق الحر للمعلومات، مما يهدد المبادئ الديموقراطية وحقوق الإنسان. الكلمات المفتاحية : المواقع الإلكترونية، حجب المواقع الإلكترونية، الأنترنت، حرية التعبير، الصحافة، القوانين الدولية، القوانين الوطنية، الميثاق الإفريقي، الميثاق العربي. Summary : This study, tagged "Blocking websites between freedom and law", aims to review the legal and social dimensions of blocking websites and provide a comprehensive analysis of its justifications and implications for freedom of expression. The study was based on the descriptive approach, as well as on analysis, as it was a subject that was often Addressed only in the press and websites. I was forced to rely heavily on examples in order to respond convincingly to the problem and make recommendations that would .help to enrich the topic The study reached several conclusions, the most important of which was the need to strike a balance between protecting national security and guaranteeing freedom of expression, i.e. withholding measures that must be clearly justified and implemented transparently to prevent possible violations of fundamental rights.
