Item الجرائم الماسة بالمعطيات الشخصية(مكتبة كلية الحقوق والعلوم السياسية - جامعة محمد البشير الابراهيمي برج بوعريريج, 2025-05) راضية مشتة; فريدة طايريصدور عدة نصوص قانونية ، سواء كانت متعلقة بالمعلومات او يحرمه الحياة الخاصة ، الا انها لم تشر إلى المعطيات الشخصية كحق يستوجب حمايته ، هذا الفراغ القانوني استمر إلى غاية صدور القانون18\07 المتعلق بحماية الأشخاص الطبيعيين في مجال المعطيات ذات الطابع الشخصي المؤرخ في 10 يونيو سنة 2018 والصادر بالجريدة الرسمية عدد 34 المؤرخة بتاريخ 10 يونيو 2018 ، والذي تضمن في فصله الثالث أحكام جزائية متعددة وما يهمنا في هذه الدراسة هي تلك الجرائم المتعلقة بالمسلسل بالمعطيات الشخصية التي سنحاول تسليط الضوء عليها وفق دراسة قانونية تحليلية نقف من خلالها على صور تلك الجرائم متعمقين في أركانها الجزائية المترتبة عنها . Summary The aim of the study is to try to stand on the legal guarantees to protect personal data from assault in light of globalization and the accompanying information technology revolutions, which allows the spread of information at the global level and this may result in many risks that will attack the privacy and freedoms of individuals, despite the issuance of several legal texts, whether related to information or deprived of private life, but it did not refer to personal data as a right that requires protection, this The legal vacuum continued until the issuance of Law 18/07 on the protection of natural persons in the field of personal data dated June 10, 2018 and issued in the Official Gazette No. 34 dated June 10, 2018, which included in its third chapter multiple penal provisions and what interests us in this study are those crimes related to the series with personal data that we will try to highlight according to an analytical legal study through which we stand on the pictures of these crimes in depth in their penal elements resulting from it.
