Item حماية حق الخصوصية في عصر الرقمنة(مكتبة كلية الحقوق و العلوم السياسية جامعة محمد البشير الابراهيمي برج بوعريريج, 2025-05-13) ذويبي الياس; لعيادي عماد الدينأصبح التعامل مع المعطيات الشخصية المتعلقة بالأشخاص أمرا شبه يومي، فكثيرا ما تتطلب الهيئات التي يتعامل معها الأفراد أن يقدم الشخص بياناته الشخصية للحصول على خدمة معينة، فتقوم تلك الهيئات بتجميع المعطيات المتاحة لديها، ثم تقوم بالإفصاح عنها لجهات أخرى للمتاجرة بتلك البيانات، وهذا ما يعد انتهاكا لخصوصية المعطيات الشخصية لهؤلاء الأفراد، وقد ازدادت هذه الانتهاكات بشكل متسارع خصوصا مع التطور التكنولوجي ورقمنة حياة الأفراد، وإتاحة بياناتهم الشخصية في البيئة الرقمية. تهدف دراسة حق الخصوصية في عصر الرقمنة إلى بيان مفهوم المعطيات الشخصية وشروط جمعها ومعالجتها، وبيان المخاطر التي تهدد أمنها وسريتها، وبيان محل الحماية الجنائية لهذه الخصوصية، وكذلك بيان الأليات القانونية المكرسة لحماية حق الخصوصية في عصر الرقمنة. الكلمات المفتاحية: حق الخصوصية- المعطيات الشخصية- البيانات الشخصية الحساسة والغير الحساسة- الحماية القانونية. Summary: Dealing with personal data related to people has become an almost daily matter, as the bodies with which individuals deal often require a person to provide his personal data to obtain a specific service, so these bodies collect the data available to them, and then disclose it to other parties to trade in that data, and this is a violation of the privacy of the personal data of these individuals, and these violations have increased rapidly, especially with the technological development and digitization of individuals' lives, and the availability of their personal data in the digital environment. The study of the right to privacy in the era of digitization aims to clarify the concept of personal data and the conditions for its collection and processing, and to indicate the risks that threaten its security and confidentiality, and to indicate the place of criminal protection of this privacy, as well as to explain the legal mechanisms dedicated to protecting the right to privacy in the era of digitization.
