دور آلية التحقيق العمومي في حماية البيئة العمرانية في ظل التشريع الجزائري

Abstract

من أجل إحداث وتحقيق التوازن بين مختلف المجالات الصناعية والاقتصادية والتنموية وكذا حماية البيئة العمرانية، تقرر اتخاذ مجموعة من الآليات الوقائية على أي مشروع تنموي كدراسات البيئية المسبقة من أجل معرفة الأضرار المحتملة الوقوع وتعزيز دور المواطن كشريك فعال في حماية البيئة العمرانية هذا من جهة وكذا تعزيز دوره في مجال العمران من جهة أخرى حيث نجد أن المشرع أعطى له حق المشاركة في صنع القرارات البيئية العمرانية والتي تخص الشؤون المحلية ونادت به الاتفاقيات الدولية وجعلته حق من حقوق الإنسان وبالتالي فهو عملية مبدئية لتكريس مبدأ الإعلام والمشاركة وهو ما يؤدي إلى تحقيق البعد البيئي والبعد العمراني على اعتبار أن كلاهما يكمل الآخر ونجد أنه وبغرض إشراك أفراد المجتمع في تدابير حماية البيئة العمرانية،أقر المشرع الجزائري استخدام التحقيق العمومي والذي يسمح للمواطنين في إّبداء رأيهم دون قيد وهذا ما يشكل أكبر دعامة أساسية لمبدأ مساهمة المواطنين في صنع القرار الإداري البيئي وتحقيق بيئة نظيفة ومحيط ذات طابع جمالي سليم ومستدام. الكلمات المفتاحية:التحقيق العمومي،البيئة، البيئة العمرانية،التحقيق الجزئي،دراسة التأثير،موجز التأثير،مخطط شغل الأراضي،مخطط التوجيهي.
