النظام القانوني للمتجر الإلكتروني في التشريع الجزائري

Abstract

المتاجرالالكترونية مثلها مثل التجارة الالكترونية، مصطلحات حديثة ظهرت بظهور الانترنت وقد عرفت انتشارا واسعا، وأصبحت أحد أكثر الوسائل المستعملة وأحدثها في عمليات البيع والشراء في عصرنا الحالي. ومن لم يساير الركب داسه السائرون بأقدامهم، فكان لزاما على المشرع الجزائري استحداث قانون يواكب هذا التطور والانتشار الواسع لهذه التجارة، وذلك بإصداره لقانون التجارة الالكترونية 18-05 والذي اعتمدت عليه دراستنا بشكل كبير خاصة تطرقه للعناصر المستحدثة للمحل التجاري الالكتروني التي لم يكن لها وجود في ظل المتاجر التقليدية. فمع هذا الانتشار الواسع لها وزيادة أهميتها والتعامل بها، أصبحت التجارة الالكترونية عامة والمتاجر الالكترونية خاصة واقع يحكم العالم الحديث والجزائر كونها جزءا منه. الكلمات المفتاحية: التجارةالالكترونية، المتجر الالكتروني، التنظيم القانوني. Study summary : E-commerce, like electronic commerce, is a modern term that emerged with the advent of the internet and has seen widespread adoption. It has become one of the most commonly used methods of buying and selling in our current era. Those who do not keep pace with the times will be left behind, as the march of progress continues unabated. Therefore, it became imperative for the Algerian legislature to introduce a law that keeps pace with this development and widespread adoption of e-commerce. This led to the issuance of Law 18-05 on Electronic Commerce, which our study heavily relied upon, especially its discussion of the innovative elements of the e-commerce platform that did not exist in traditional stores. With its widespread adoption and increasing importance, e-commerce, in general, and e-commerce stores, in particular, have become a reality governing the modern world, with Algeria being a part of it.
