خصوصية التحقيق في الجرائم الالكترونية

Abstract

تعد الجرائم الالكترونية من اخطر التحديات الأمنية التي تواجه أعضاء المجتمع الدولي فهي جرائم معقدة ترتكب بوسائل تقنية حديثة ومتطورة من قبل مجرمين على مستوى عال من الذكاء مما يجعل التحقيق فيها صعب بحيث أن الصور التقليدية لإجراءات التحقيق التي تقوم بها الجهات المكلفة بالبحث والتحري عن الجريمة لا تتماشى وطبيعة الجرائم الالكترونية و التي تتميز بخصائص وصفات تجعلها صعبة الإثبات لعدم وجود آثار مادية وتقليدية وهو ما يتطلب منظومة قانونية وقضائية فعالة تتولى مسألة التحقيق في هذا النوع من الجرائم. وقد تطرقنا في هذه المذكرة إلى دراسة إجراءات التحقيق في الجريمة الالكترونية وما تنفرد به من خصوصية تجعلها تتميز عن إجراءات التحقيق في الجريمة التقليدية، حيث يهدف إجراء التحقيق في البيئة الرقمية إلى الكشف عن جرائمها وفحص و جمع الأدلة المتحصل عليها من الوسط الإجرامي ونسبتها إلى فاعلها، والتي لا تتحقق إلا من خلال تكاثف جهود أجهزة وهيئات تحقيق خاصة متمكنة تقنيا وفنيا في مجال تكنولوجيا المعلومات، حيث تشمل إجراءات تحقيق تتمثل في المعاينة والمراقبة الالكترونيين بالإضافة إلى إجراء التفتيش الالكتروني، وقد استحدث المشرع الجزائري إجراءات تحقيق خاصة تمثلت في إجراء اعتراض المراسلات وتسجيل الأصوات والتقاط الصور، وكذا إجراء التسرب، كما تكمن خصوصية التحقيق في الجريمة الالكترونية من حيث وسائل جمع الأدلة الرقمية وإجراءات الحصول عليها، حيث تطرق المشرع إلى هذه الإجراءات الخاصة في قانون الإجراءات الجزائية الجزائري على سبيل الحصر المعدل سنة 2006 ، الإضافة إلى القانون رقم 09/04 المتعلق بالوقاية من الجرائم المتصلة بتكنولوجيا الإعلام والاتصال ومكافحتها وهو أول قانون إجرائي خاص في مكافحة الجريمة الالكترونية . ورغم الصعوبات الكبيرة التي تعترض الجهات المختصة، إلا أنها في مرة تصدر قوانين وإجراءات تحكم هاته الجرائم رغم التطور الرهيب لوسائل وكيفيات ارتكاب مثل هذه الجرائم العابرة للحدود الدولية. الكلمات المفتاحية: الجريمة الالكترونية-التحقيق- الدليل الرقمي- الإجراءات المستحدثة في التحقيق- الصعوبات.

Summary Cybercrimeisconsidered one of the mostserioussecurity challenges facingmembers of the international community. These are complex crimes committedusingadvanced and modern technologicalmeans by highly intelligent criminals, whichmakesinvestigatingthemdifficult. Traditionalmethods of investigation used by authorities in charge of crime detection do not alignwith the nature of cybercrimes, whichpossesscharacteristicsthatmakethem hard to prove due to the lack of physical and conventionalevidence. This necessitates an effective legal and judicialframeworkdedicated to investigatingsuch types of crimes. In thismemorandum, weexamined the proceduresinvolved in investigatingcybercrime, which are distinguished by their unique nature compared to thoseused in traditional crime investigations. The aim of conducting investigations in the digital environmentis to uncoverthese crimes, examine and collectevidenceobtainedfrom the criminal setting, and attributeit to the perpetrator. This canonlybeachievedthrough the cooperation of technically and professionallyskilledinvestigative bodies specialized in information technology. Theseproceduresincludeelectronic inspection and surveillance, in addition to digital search. The Algerian legislator has introducedspecialinvestigativeproceduressuch as the interception of communications, recording of voices, capturing of images, and infiltration operations. The specificity of cybercrime investigations also lies in the tools and proceduresused to gather digital evidence. The legislatoraddressedthesespecificprocedures in the Algerian Code of CriminalProcedure, as amendedin 2006, as well as in Law No. 09/04 concerning the prevention and fightagainst crimes related to information and communication technology, whichis the first procedurallawtargetingcybercrime. Despite the significant challenges faced by the relevant authorities, laws and procedures continue to beissued to regulatethese crimes, in spite of the rapidevolution of the means and methodsused to commit such transnational crimes.
