مكافحة الجريمة السيبرانية الماسة بالطفل في التشريع الجزائري

Abstract

تعالج هذه المذكرة موضوع مكافحة الجريمة السيبرانية الماسة بالطفل في التشريع الجزائري، وهو من المواضيع الحديثة التي فرضها الانتشار الواسع للتكنولوجيا والإنترنت، وما رافقه من مخاطر تهدد فئة الأطفال بشكل خاص. فقد أصبح الطفل معرضًا لأنواع متعددة من الجرائم الإلكترونية، مثل الاستغلال الجنسي، الابتزاز، التنمر، والإغواء عبر الشبكات. تسعى الدراسة إلى توضيح الإطار القانوني الذي يحكم حماية الطفل من هذه الجرائم، من خلال تحليل التعاريف القانونية للطفل، وبيان كيفية تطور أهليته، مع شرح طبيعة الجريمة السيبرانية وخصائصها وأركانها. كما تتناول المذكرة الجهود التي بذلها المشرّع الجزائري من خلال النصوص القانونية والآليات المختلفة، سواء في مجال الوقاية أو الردع أو المعالجة. وخلصت الدراسة إلى أن حماية الطفل من الجريمة السيبرانية تتطلب تطويرًا مستمرًا للمنظومة القانونية، وزيادة الوعي الرقمي لدى الأسرة والمجتمع، وتكثيف التعاون بين مختلف الجهات المختصة لضمان بيئة إلكترونية آمنة للأطفال. Summary This thesis addresses the topic of combating cybercrime against children in Algerian legislation, a modern issue that has emerged with the widespread use of technology and the internet, bringing along serious risks that particularly affect children. Today, children are exposed to various forms of cybercrime, such as sexual exploitation, blackmail, cyberbullying, and online luring. The study aims to clarify the legal framework governing the protection of children from these crimes by analyzing legal definitions of the child and the evolution of their legal capacity. It also explores the nature, characteristics, and legal components of cybercrimes. Additionally, the thesis examines the efforts made by Algerian lawmakers through laws and mechanisms designed for prevention, deterrence, and intervention. The study concludes that protecting children from cybercrime requires the continuous development of the legal system, increased digital awareness among families and society, and stronger cooperation between all relevant authorities to ensure a safe digital environment for children.
