Abstract

تعتبر الجريمة الإلكترونية من الجرائم المستحدثة التي تتطلب لارتكابها وسائل ذات تقنية عالية، وعليه فإجراءات التحقيق فيها تتمتع بنوع من الخصوصية نظرا لطبيعة الجريمة الإلكترونية،هذاما دفع بالمشرع الجزائري إلى تدعيم ترسانته القانونية بقانون خاص زود من خلاله المحقق بالمزيد من القواعد الإجرائية و الوقائية التي بدورها تسهل التحريات في مكافحة هذا النوع من الإجرام, فقد سن القانون 09-04 المؤرخ في 05 أوت 2009 المتضمن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيا الإعلام والاتصال ومكافحتها، الذي جاء لينسق بين القواعد الإجرائية الخاصة(كتفتيش المنظومات وحجز المعطيات المعلوماتية) والهدف من ذلك هو إمكانية الكشف المبكر عن هذا النوع المستحدث من الجرائم الذي يهدد العالم بأسره. الكلمات المفتاحية:الجريمة الإلكترونية، التحقيق الجنائي، إجراءات التحري، التشريع الجزائري.
