Abstract

تتناول هذه المذكرة موضوع التحقيق في الجريمة الإلكترونية، باعتباره من المواضيع المستحدثة التي فرضتها الثورة الرقمية، وما صاحبها من تطور في أساليب ارتكاب الجريمة عبر الوسائط الإلكترونية. وتهدف الدراسة إلى بيان الخصائص القانونية والفنية للجريمة الإلكترونية، وتسليط الضوء على الإجراءات المعتمدة في التحقيق فيها، مع إبراز الصعوبات التي تواجه أجهزة العدالة في هذا المجال، سواء على مستوى جمع الأدلة الرقمية، أو من حيث التكييف القانوني، أو على صعيد التعاون الدولي في مكافحة هذه الظاهرة. الكلمات المفتاحية : التحقيق الجنائي – الجريمة الإلكترونية – الأدلة الرقمية

Study summary This memorandum addresses the topic of cybercrime investigation, a newly emerging topic imposed by the digital revolution and the accompanying development in the methods of committing crimes via electronic media. The study aims to outline the legal and technical characteristics of cybercrime, highlight the procedures adopted in its investigation, and highlight the difficulties facing judicial bodies in this area, whether at the level of collecting digital evidence, in terms of legal classification, or at the level of international cooperation in combating this phenomenon.
