المسؤولية المدنية الناتجة عن تطبيق تقنيات الذكاء الإصطناعي

Abstract

أدى انتشار أنظمة الذكاء الاصطناعي في مختلف القطاعات إلى تحقيق منافع كبيرة، إلا أنه أثار ‏تحديات قانونية تتعلق بتحديد المسؤولية عن الأضرار الناتجة عنها، نظراً لصعوبة إخضاعها للسيطرة ‏البشرية. ويُعد تحديد الطبيعة القانونية لهذه الأنظمة مدخلاً أساسياً لوضع إطار قانوني للمسؤولية المدنية‎.‎ ‎‎وتتباين الآراء بين منح هذه الأنظمة شخصية قانونية مستقلة تُساءل عن أفعالها، أو اعتبارها أشياء تُطبق ‏بشأنها قواعد مسؤولية الحارس. وقد بيّنت الدراسات قصور التشريع المدني الجزائري في هذا المجال، مما ‏يستوجب اقتراح أسس قانونية حديثة تسد هذا الفراغ وتواكب تطورات الذكاء الاصطناعي‎.‎ الكلمات المفتاحية‎:‎أنظمة الذكاء الاصطناعي، المسؤولية المدنية، الشخصية القانوني.‏ Abstract:‎ ‎ The widespread adoption of artificial intelligence (AI) systems across ‎various sectors has led to significant benefits; however, it has also raised ‎legal challenges, particularly concerning the attribution of liability for damages ‎caused by such systems, given the difficulty of maintaining human control ‎over them. Determining the legal nature of these systems is a fundamental ‎step toward establishing a legal framework for civil liability.‎ ‎ Opinions diverge between granting AI systems independent legal ‎personality, thereby holding them accountable for their actions, and treating ‎them as objects subject to the legal rules governing custodial liability. Studies ‎have highlighted the inadequacy of Algerian civil legislation in this regard, ‎necessitating the proposal of modern legal foundations to address this gap ‎and keep pace with developments in artificial intelligence.‎ Keywords: Artificial Intelligence Systems, Civil Liability, Legal Personality‎
