حماية البريد الإلكتروني في القانون الجزائري

Abstract

يعد البريد الالكتروني اليوم واحدا من أهم وأحدث التطبيقات الاكثر انتشارا واستخداما في العصر الحالي نظريا لسهولة استخدامه وقلة تكلفته، والذي قدر عدد مستخدميه عام 2009 إلى 1.9 بليون مستخدم حول العال مع توقعات ارتفاع عدد مستخدميه مستقبلا ، لكن وعلى الرغم من هذه المكان، والاهمية البالغة التي حضي بها لم يمنه ذلك من تولد الكثير من المشاكل منها القانونية وأخرى تقنية تمثلت في القرصنة الالكترونية بمختلف أنواعها والمعروفة بجرائم الاعتداء على البريد الالكترونين وقد هدفت هذه الدراسة لتسليط الضوء على ما جاء به المشرع من آليات لفرض الحماية سواء على المستوى القانوني أو المؤسساتي، إذ أن هناك جهود دولية من بينها سن القوانين لمواجهاتها وأخرى وطنية لحماية البريد الالكترونية والاقتراح على المشرع بضرورة وضع آليات أكثر فاعلية للحماية. الكلمات المفتاحية: البريد الالكتروني – التشريع الجزائري القانون الجزائري

Sumary : E-mail today is one of the most important and latest applications most widespread and used in the current era due to its ease of use and low cost, which was estimated in 2009 to 1.9 billion users around the world, with expectations of an increase in the number of users in the future. But despite this position and the great importance it enjoyed, this did not prevent the generation of many problems, including legal and other technical, represented in electronic piracy of various means and types, known as crimes of assault on e-mail. The aim of the study was to highlight the lgislator’s use of mechanisms for the imposition of protection at both the legal and institutional levels, which had been achieved, if ther were international efforts, including the enactment of laws to counter them, a national email protection mechanisms and a proposal to the legislature that more effective protection mechanisms should be put in place . keywords : Email – algerian Legislation
