دور براءة الإختراع في تطوير الإقتصاد الوطني

Abstract

من خلال دراسة نظام براءة الاختراع في التشريع الجزائري، يتضح أن المشرع الجزائري وفي سبيل مسايرة التحولات التكنولوجية والاقتصادية، عمل على تطوير الإطار القانوني لحماية الملكية الفكرية بصفة عامة، وبراءة الاختراع بصفة خاصة، باعتبارها من أهم الأدوات القانونية التي تساهم في تشجيع الابتكار التنمية. إذ تُعد براءة الاختراع وسيلة فعالة لحماية الجهد الفكري والابتكارات التقنيةوتحقيق، وتمكين أصحابها من حقوق احتكارية تساعدهم على استثمار اختراعاتهم بأمان. لقد أدرج المشرع الجزائري أحكامًا خاصة ببراءة الاختراع ضمن المنظومة الوطنية لحماية الملكية الصناعية، سواء من خلال قانون 07-03 المتعلق بالملكية الفكرية، أو من خلال التزامات الجزائر في الاتفاقيات الدولية ذات الصلة (اتفاقية باريس، تريس)، مما يدل على وعي تشريعي بأهمية حماية الحقوق الفكرية في دعم الاقتصاد الوطني وتطوير البحث العلمي. كما منح القانون لصاحب البراءة حقوقًا استئثاريه تخوّله استغلال اختراعه، وفي الوقت نفسه فرض عليه التزامات تهدف إلى تحقيق التوازن بين المصلحة الفردية والمصلحة العامة. وقد أبرزت الدراسة كذلك أن الحماية المقررة لبراءة الاختراع لا تقف عند حدود المنح فقط، بل تمتد إلى الرقابة والجزاء في حال التعدي، إضافة إلى الإجراءات المرتبطة بانقضاء الحق أو إسقاطه. بالنتيجة أصبح من الواضح جدا أن براءة الاختراع تشكل ركيزة أساسية في دفع عجلة التنمية الاقتصادية، تحفظ الحقوق الفكرية للمبتكرين، تحفزهم أكثر على العطاء، تساهم في جذب الاستثمارات ونقلالتكنولوجيا، وبالنتيجة خلق فرص عمل، لذلك فتشجيع ثقافة الاختراع وتوفيربيئة قانونيةوتشريعية فعالة لحماية براءات الاختراع يعدان من العوامل الحيوية التي ينبغي أن تحظى باهتمام خاص ضمن السياسات التنموية لأي دولة تطمح إلى بناء اقتصاد قائم على المعرفة والابتكار.

Abstract: By examining the patent system in Algerian legislation, it becomes clear that the Algerian legislator, in order to keep pace with technological and economic transformations, has worked to develop the legal framework for the protection of intellectual property in general, and patents in particular, as one of the most important legal tools that contribute to encouraging innovation and development. Patents are an effective means of protecting intellectual effort and technical innovations, and enabling their owners to securely exploit their inventions.

The Algerian legislator has included provisions specific to patents within the national system for the protection of industrial property, both through Law 03-07 on Intellectual Property and through Algeria's obligations in relevant international agreements (Paris Convention, TRIOS). This demonstrates a legislative awareness of the importance of protecting intellectual property rights in supporting the national economy and developing scientific research.

The law also grants patent holders exclusive rights that enable them to exploit their inventions, while simultaneously imposing obligations aimed at achieving a balance between individual and public interest. The study also highlighted that the protection provided for patents goes beyond granting them, but extends to monitoring and penalties in the event of infringement, in addition to procedures related to the judicial review or forfeiture of the right.

As a result, it has become abundantly clear that patents constitute a fundamental pillar in driving economic development. They preserve the intellectual rights of innovators, further motivate them to contribute, contribute to attracting investment and technology transfer, and ultimately create job opportunities. Therefore, encouraging a culture of invention and providing an effective legal and legislative environment for patent protection are two vital factors that should receive special attention within the development policies of any country aspiring to build a knowledge- and innovation-based economy.
