جريمة القرصنة الإلكترونية في التشريع الجزائري

Abstract

تهدف هذه الدراسة إلى التعرف على جریمة القرصنة الإلكترونیة والتي تعتبر من أخطر أنواع الجرائم الإلكترونیة لما لها من آثار سلبیة على النظام المعلوماتي من حیث الاعتداء على المعلومات بالحذف أو التغییر أو الإتلاف، وفي هذه الدراسة قمنا بدراسة الإطار المفاهیمي لهذه الجریمة والجوانب الموضوعیةوالإجرائیة التي اتبعها المشرع الجزائري للحد منهذه الجریمة ومكافحتها وأبرز المشاكل القانونیة التي تحیطبجریمة القرصنة الإلكترونیة. الكلمات المفتاحیة: جریمةإلكترونیة – قرصنة إلكترونیة – النظام المعلوماتي – مكافحة. Abstract This studyaims to identify the crime of cyber hacking whichis considered one of the mostdangerous types of cyber crimes because of itsnegativeeffects on the information system in terms of attacking information by deleting, changing or destroying. In thisstudy, we have studied the conceptualframework of this crime and the substantive and procedural aspects that the Algerian legislator followed to reduce and combat this crime and the mostprominent legalproblemssurrounding the crime of cyber hacking.
