مجابهة الجريمة الإلكترونية في التشريع الجزائري

Abstract

ركز المشرع الجزائري اهتماما كبيرا على مواجهة جريمة الإنترنت، حيث وضع إجراءات وتدابير متعددة للتصدي لهذا النوع الجديد من الجرائم. ولتحقيق ذلك، اتبع المشرع سياسة مزدوجة في المكافحة، فقد أجرى تعديلات مهمة على قانون العقوبات بدءا من تعديل عام 2004 بالقانون رقم 04-15، ثم في تعديل آخر سنة 2006 بموجب القانون رقم 06-22 المعدل والمتمم لقانون الإجراءات الجزائية، والتي تشكل القواعد العامة لمكافحة هذه الجرائم. لكن المشرع لم يكتفِ بهذا فقط، بل قام أيضا بإصدار قوانين خاصة تركز على الوقاية والقمع، من أبرزها القانون رقم 09-04 الذي يحتوي على قواعد خاصة بالوقاية المتعلقة بتكنولوجيا الإعلام والاتصال ومكافحة الجرائم الإلكترونية. والهدف الأساسي من هذه التشريعات هو القضاء على هذه الجرائم الخطيرة، أو على الأقل الحد من انتشارها وتأثيرها. الكلمات المفتاحية: الجريمة الإلكترونية، التجريم، التحقيق، المجابهة الجزائية، المؤسسات، الأدلة الرقمية. Abstract : The Algerian legislator has placed great emphasis on combating cybercrime by establishing various measures and procedures to address this emerging type of crime. To achieve this, the legislator adopted a dual approach in combating it, making significant amendments to the Penal Code, starting with the 2004 amendment under Law No. 04-15, followed by another amendment in 2006 under Law No. 06-22, which amended and supplemented the Code of Criminal Procedure. These amendments form the general framework for combating such crimes. However, the legislator did not stop there; special laws were also enacted focusing on prevention and repression, most notably Law No. 09-04, which includes specific provisions related to the prevention of cybercrime through information and communication technology. The primary goal of these legislations is to eliminate these serious crimes or at least reduce their spread and impact.
