Abstract

إن موضوع إجراءات متابعة الجرائم الإلكترونية ذات البعد الوطني، من خلال تحليل الأطر القانونية والمؤسساتية المعتمدة في التصدي لها. وتركز الدراسة على الهيئات المكلفة بمواجهة هذا النوع من الجرائم، سواء تلك ذات الاختصاص العام، كجهاز النيابة العامة وضباط الشرطة القضائية، أو الجهات المتخصصة، كالوحدات التقنية للشرطة والدرك الوطني. وتتناول المذكرة مختلف مراحل البحث والتحقيق، بدءًا من تلقي الشكاوى والمحاضر، مرورًا بالاستجواب والتفتيش، وانتهاءً بندب الخبراء. كما تطرقت إلى مرحلة المحاكمة من حيث تحديد الاختصاص القضائي والإجراءات القضائية المعتمدة. وخلصت الدراسة إلى أن التصدي الناجع للجرائم الإلكترونية يقتضي تحقيق تكامل بين النصوص التشريعية والمؤسسات المعنية، فضلاً عن ضرورة التحديث المستمر للوسائل القانونية والتقنية بما يواكب تطور هذا النوع من الإجرام ويعزز فعالية الردع والزجر. الكلمات المفتاحية: الجريمة الالكترونية، الضبطية القضائية، المتابعة الجزائية، الاستجواب . Summary in English The topic concerns the procedures for addressing cybercrimes of a national scope, through an analysis of the legal and institutional frameworks adopted to combat them. The study focuses on the authorities tasked with confronting this type of crime, whether those with general jurisdiction—such as the Public Prosecution Office and judicial police officers—or specialized bodies, such as the technical units of the police and national gendarmerie. The thesis examines the various stages of investigation and inquiry, starting from the receipt of complaints and official reports, through interrogation and searches, and concluding with the appointment of experts. It also addresses the trial phase in terms of determining judicial jurisdiction and the judicial procedures followed. The study concludes that effectively combating cybercrime requires coordination between legislative texts and the concerned institutions, as well as the continuous updating of legal and technical tools to keep pace with the evolution of this type of crime and to enhance the effectiveness of deterrence and enforcement.
